You need to have a formal written aggreement if you decide to allow it. In some cases you may have no choice if it is an"Eminent domain" situation where the Government or government agency deems it neccessary to have certain rights to your land. - Earlier today

Actions speak louder than words:
1) Did she assist you in finding financing?
2) Did she assist you in getting into the home?
3) Did she assist in the negotiations?
After 8 months she appears to not be listening to you.
In court, it is doubtful that her contract would not hold up if she cannot answer "yes" to the questions posed above.

Be careful with the FSBO's...especially on an appraisal versus what loan you can get. Also, make sure to have insurance quotes in hand before you make your final decision on this house. - Wed Jul 1 2009, 07:08

A couple of us in the office are starting an aggressive campaign to get the word out about the first time homebuyer assistance for Orleans Parish..and the combo effect one gets when you throw in the $8K from Uncle Obama...you see...we all have a rich uncle now!

Buyers can get as much as $60K, PLUS another $10K for closing cost assistance.

You need to find out what homes are selling for. I would advise selling before you HAVE to sell. If you wait, you are reducing your negotiating power down the road.

A professor once told us, "Always negotiate from a position of strength". Your strength right now for your situation is to sell.

What you have to negotiate is time and money...the two major resources. With enough money, time means little...you can build, buy or sell as fast or slow as you want.

With enough time, you have the opportunity to ask a premium price...if it does not move the property adjust as needed. Do not make any decision based on the nightly news....real estate housing markets are driven by local demand, not some guy in Detroit making $80 an hour to make widgets and his job moves to China.

In Sorrento, you have all those refineries cranking out oil, gas and plastics. If you go to the Walmart parking lot and stop seeing crazed shoppers, and all of us start taking bikes to work, then I would start being concerned.

Sleep is worth alot of money...if the house is sold, you can focus on building your business....for the rental is but a temporary situation in a lifetime of experiences. - Wed Jun 10 2009, 20:49
