Want to put an offer on a property that is in contingent status, but the listing agent said she is not

accepting back-up offers. Can she do that?

If the seller has instructed her that they do not want to consider any other offers, yes

Have your agent call the listing agent and ask if she can be notified if the current deal falls apart and have all your "ducks' in a row to submit a clean offer if this should happen.

FIRST ANSWER

In Texas the home owner can just wait on the contingent offer to close and not accept backups. Unsure about CA laws.
