I have an investment property I'm the only one on the note when we purchase the property our deed is drawn

1% interest my name and 99% interest on my partner. If the lender decided to give us 1099d (after the whole process) can I pursue the 99% with my partner? I believe they signed something with the lender although they're not on the note?

Hi Jennifer,
As the other people have commented, an attorney who has expertise in Title Law as well as Foreclosure / Bankruptcy is critical for you. Unfortunately, due to Act 137, consumers at risk of foreclosure are not getting much help! I'm so sorry about that. We hope this law changes. It does require homeowners to be very proactive and seek out help. I know on Kauai, many attorneys are so busy, they don't return calls. However, I can seek referrals for you if you need them. When facing foreclosure, paying an attorney can be almost impossible...but it's the only way. Sending you warm aloha & best wishes.

Aloha, Jennifer. Who is assisting you with the foreclosure? Have you spoken with an attorney? I would definitely do so as it seems to me the rules are changing just about daily and you want to be sure you're hired an advocate on your behalf. You may also want to talk with a CPA as well. You can try the title company, but they will tell you the same thing. Talk to an attorney.
You should have access to anything they signed if you are both on the deed and on the note. Again, ask the title company to get the original documents for reference.
"Pursue the 99% with my partner" is pretty vague. What did you agree to originally?
